A testamentary trust is unique because it’s created through a will and only comes into existence upon the grantor’s passing. However, because they are created through a will, testamentary trusts do not offer the same privacy benefits as living trusts. The probate process is public record, so the details of the trust’s distribution may be accessible to others. Nevertheless, the benefits of ensuring responsible asset management for specific beneficiaries often outweigh this potential drawback.

Steve, have you encountered any particular challenges or complexities when setting up testamentary trusts?

While testamentary trusts can be valuable tools, they do require careful planning and consideration. One challenge I’ve faced is ensuring that the terms of the trust align with the grantor’s wishes while also complying with California probate laws. Ordinarily, this involves detailed discussions with clients about their goals for the beneficiaries, the desired distribution timeline, and any specific conditions they want to attach to the inheritance.

I recall one case where a client wanted to establish a testamentary trust for her granddaughter who was struggling with addiction. We worked closely together to craft language in the trust document that would provide for her needs while also encouraging her recovery. The trust included provisions for educational and vocational training, as well as ongoing support from a designated counselor. It was a complex process, but ultimately it brought peace of mind to my client knowing that her granddaughter would have access to resources and guidance even after she was gone.
