Interview with Steve Bliss, San Diego Probate Attorney

Good morning, San Diego! Today, we’re joined by Steve Bliss, a leading probate attorney here in San Diego. Mr. Bliss specializes in estate planning and has helped countless families navigate the complex legal landscape of wills, trusts, and probate.

Choosing The Right Trust for Your Needs

Steve, thank you so much for joining us. Let’s talk about trusts. There are many different types available, each with its own advantages and disadvantages. For someone just starting to think about estate planning, what would be a good first step?

“It’s fantastic to be here. You’re right, the world of trusts can seem overwhelming at first. Ordinarily, I recommend clients start by considering a revocable living trust. It’s incredibly versatile and allows you to maintain control over your assets during your lifetime while avoiding probate after your passing.

A revocable living trust lets you specify exactly how your assets will be distributed upon your death. Moreover, it offers privacy, as the terms of the trust aren’t part of public record like a will. Consequently, this can be a significant advantage for individuals who value discretion.”

Challenges with Revocable Living Trusts

That sounds incredibly helpful. Are there any potential drawbacks to a revocable living trust?

“While revocable living trusts are generally excellent tools, they’re not without their complexities. Setting up a trust requires careful planning and attention to detail. It’s crucial to work with an experienced attorney who understands California law and can tailor the trust to your specific needs. “I remember one case where a client tried to set up a trust on his own using online templates. Unfortunately, he made some critical errors that could have resulted in significant tax implications for his heirs.

Fortunately, we were able to identify and correct those mistakes before it was too late. This experience underscores the importance of seeking professional guidance when dealing with estate planning matters.”

Finding Peace of Mind

“According to a recent study by the American Bar Association, over 60% of Americans don’t have a will or trust in place. This can leave their loved ones facing significant financial and legal challenges after their passing.

Creating a well-structured estate plan brings peace of mind knowing your wishes will be honored and your family is protected. ”
