What inspired you to focus your legal practice on protecting seniors?

Well Penny, it’s a deeply personal calling for me. I’ve always been close to my grandparents, and seeing them vulnerable as they aged opened my eyes to the unique challenges our elder population faces. It just feels right to use my legal skills to advocate for those who may not be able to protect themselves.

Let’s talk about the Elder Protection process. Can you give us a roadmap of what steps are typically involved?

Of course, Penny. Think of it as a multi-step journey aimed at ensuring an elder’s safety and well-being.

  • Initial Client Engagement: This is where we get to know the client, understand their situation, and assess any potential conflicts.
  • Case Assessment: We identify the specific legal issues at hand, gather evidence, and evaluate the risks involved.
  • Protective Actions: Depending on the urgency, this could involve seeking restraining orders, freezing financial accounts, or arranging for safer living arrangements.
  • Legal Proceedings: If necessary, we pursue civil litigation, criminal prosecution, or guardianship proceedings to protect the elder’s rights.
  • Long-Term Planning: This crucial step focuses on safeguarding the elder’s future through estate planning, advance directives, and ongoing oversight.

Today we’re going to focus in depth on Protective Actions. Can you elaborate on that stage?

“Protective actions are often the most critical part of the process,” Ted explains. “They’re about immediately addressing threats and minimizing harm. Imagine a situation where an elderly individual is being financially exploited by a family member or caregiver. We might need to freeze bank accounts, prevent unauthorized transactions, or even seek a restraining order to protect them from further abuse.”

“Another scenario might involve an elder who’s physically or emotionally abused. In those cases,” Ted continues, “we work with Adult Protective Services (APS) and law enforcement to ensure their safety.
