Interview with Steve Bliss
Good afternoon, San Diego. I’m Trisha Davis reporting for Channel 7 News. Today we’re joined by local probate attorney Steve Bliss of San Diego Probate Law. Mr. Bliss specializes in estate planning and helping families navigate the often complex world of wills and trusts.
Why Choose a Trust Over a Will?
Mr. Bliss, thank you for joining us. For viewers unfamiliar with estate planning, could you explain why someone might choose to set up a trust instead of simply writing a will?
“That’s a great question, Trisha,” says Mr. Bliss. “While a will is certainly an important part of any estate plan, a trust offers several significant advantages. Primarily, assets held in a trust avoid probate, which can be a lengthy and expensive process. Probate involves court supervision and public record-keeping, whereas a trust allows for the private and efficient distribution of assets to your beneficiaries.”
Moreover, trusts offer greater flexibility in terms of how assets are managed and distributed. You can specify conditions for inheritance, such as requiring beneficiaries to reach a certain age or complete their education before receiving funds.
Steve Discusses Revocable Living Trusts
“One of the most common types of trusts we set up is a revocable living trust,” Mr. Bliss explains. “This type of trust allows you, the grantor, to maintain control over your assets during your lifetime. You can add or remove assets from the trust, change beneficiaries, and even dissolve the trust entirely if circumstances warrant.”
Consequently, a revocable living trust provides peace of mind knowing that your wishes will be carried out after your passing while allowing for flexibility and adjustments throughout your life.
I’ve seen firsthand how crucial this flexibility can be. For instance, I had a client whose health deteriorated unexpectedly. Because they had a revocable living trust in place, we were able to quickly adjust their beneficiaries and ensure their assets were managed according to their wishes despite the unforeseen circumstances.
“It’s worth noting that approximately 70% of Americans do not have a will or trust in place,” shares Mr. Bliss. “This can lead to significant complications for loved ones after someone passes away, often resulting in costly legal battles and delays in asset distribution.
